Auctie's is a registered trademark belonging to ROSSINI, a Société Anonyme with a Board of Directors, having its registered office at 7 rue Drouot 75009 PARIS, registered under number 428 867 089.

ROSSINI (hereinafter " Rossini " or " Nous ") is an operator of voluntary sales of furniture by public auction governed by articles L.321-4 et seq. of the French Commercial Code. In this capacity, Rossini acts as the seller's agent.

 The relationship between Rossini and the purchaser (hereinafter the " Purchaser " or " You ") is subject to these general conditions of sale.

 The voluntary sale is subject to French law and will expressly be for cash.

 

1. Before the sale

1.1  Online estimate service

 Estimates are provided for information only, and should in no way be analyzed as a certainty that the item will be sold at the estimated price or within the estimate range.

The estimates provided by Rossini in no way constitute a guarantee, and are likely to vary prior to the sale.

Any offer made within the estimate range has a reasonable chance of success. When submitting a request for an estimate, the applicant agrees to receive solicitations by email or telephone (SMS).

This estimate service is delivered free of charge. The applicant submitting a request agrees to assign the rights of use pertaining to the photos, texts, documents shared at the time of submission, for all useful purposes. These elements may be exploited by Rossini for the purpose of enriching its online databases.

 

1.2  Condition of lots

 We are at your disposal to provide You with a detailed report on the condition of the lots.

All goods are sold in the condition in which they are at the time of sale, notwithstanding any imperfections or defects. No claim will be admissible once the adjudication has been pronounced, the successive exhibitions and the possibility of requesting a detailed report having enabled the Purchasers to examine the condition of the items offered for sale.

It is specified that visitors and prospective Purchasers, have, upon simple request, the possibility of access to a more complete examination of the objects presented.

 

1.3  Exhibition prior to the sale

 The exhibition prior to the sale is open to all.

 Rossini endeavors to display the objects in the safest manner in the interests of safety. You are prohibited from handling objects without Rossini's authorization.

 Any handling of objects not supervised by Rossini is at your own risk.


2. Bidding

Bids may be made in person, by telephone or through a third party. Bids will be conducted in euros.


 2.1  Bidding in person

 In order to be able to take part in the bidding in person, a means of payment (cheque or bank card details) and the buyer's civil status (personal information) domicile, must first be deposited by the prospective Buyer with the auction house. A plaque number will be issued in return. This number will be used to identify the Purchaser in the event of lot acquisition.

Access to the sales room is free of charge, and requires no pre-registration.

When the bid is served, the potential Purchaser present in the sales room gestures to the auctioneer in order to bid.

If there is the slightest doubt about the price or the Buyer of an item during the bidding, You can immediately draw the attention of the person authorized to conduct the sale.

Rossini conducts the sale while ensuring that the freedom of bidding is respected. 

 

2.2  Bidding by telephone

If You cannot be present on the day of the auction, You have the option of bidding directly by telephone, provided that You have made yourself known 24 (twenty-four) hours before the sale.

We also recommend that You indicate a covering purchase order that we can execute on your behalf in the event that we are unable to reach You.

Rossini cannot be held responsible for any technical difficulties due to a poor telephone connection.

 

2.3  Mandate to a third party bidder

When You bid during the sale, You do so in a personal capacity and we may hold You solely responsible for payment of the auction price as well as any tax or duty that may be due, unless You have previously notified us that You are bidding in the name and on behalf of a third party by providing us with a regular mandate that we will have previously registered.

 

2.4  Purchase orders

In the event that You are unable to attend the sale, Rossini offers to execute the purchase orders that You will have transmitted to us prior to the sale, before, during, or after the exhibitions in writing, in euros, and in Your name

This service is free of charge and confidential.

Lots are purchased at the best price, respecting the reserve price stipulated by the seller, and other bids. In the event of several purchase orders for identical bid amounts, the oldest order will be given preference and win the sale.

Unlimited or "buy at any price" bids will not be accepted. The purchase order indicates the maximum price beyond which the Buyer does not wish to bid.

Written orders may be sent:

 You may also leave purchase orders by telephone but these must be confirmed in writing before the sale. In order to ensure satisfactory service to bidders, You are asked to ensure that we have received your purchase order at least 24 (twenty-four) hours before the sale.

 

3. The sale 

3.1  Conditions of sale

As indicated above, the auction is governed by legal rules and those set out in this text. Anyone intending to bid must carefully read the present terms and conditions, which are available as an appendix to the sales catalogs distributed online or on paper. They may be modified by posting in the sales room or by announcements made by the person authorized to conduct the sale.

 

3.2  Access to lots during the sale

For security reasons, access to lots will be prohibited during the sale.

 

3.3  Conduct of the sale

The order of lots will be followed during the sale.

Auctions begin and continue at the level deemed appropriate by the person authorized to conduct the sale. The latter reserves the right to bid successively or in response to other bids, and to do so in the name and on behalf of the seller up to the reserve price.

 

4. After the sale

4.1  Results of the sale

The results of the sale and the purchase orders You have placed are available from Rossini, at the following number : +33 1 42 72 03 65.

 

4.2  No right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, voluntary sales organized by Rossini are not subject to any right of withdrawal.

The sale is perfected upon adjudication.

 

4.3  Payment

The Purchaser proceeds with payment of the lot as well as fees and taxes, in cash, immediately after the sale. Payment may be made:

4.4  Buyer's commission

The Buyer will pay to the order of ROSSINI, in addition to the hammer price, a buyer's commission of:


4.5  Default of payment

The auctioned property may only be delivered to the Purchaser when Rossini has received the price or when any guarantee has been given to Rossini regarding payment of the price by the Purchaser.

In the event of default of payment, after formal notice has remained unsuccessful, and in accordance with the provisions of the French Commercial Code, the property will be put back up for sale at the request of the seller upon reiteration of the bids.

Failing this, the sale will be cancelled ipso jure.

Charges may be applied against the defaulting successful bidder.

 

4.6  Removal of purchases

Rossini is responsible to the buyer for the delivery of the property for which it has made the sale.

Purchases may only be removed when Rossini has received full payment. All lots may be collected during or after the sale upon presentation of a delivery authorization from Rossini's accounting department, or failing this, a slip marked " réglé " or " payé ".

Buyers will be able to obtain all information concerning the delivery and shipment of their purchases at the end of the sale. Rossini will store the item free of charge at the end of the sale for a period of 15 (fifteen) days. From the 16th day onwards, storage charges of €3 excl. VAT/day will be invoiced, without prior information, as the Purchaser must make every effort to recover his goods at the end of each sale.

 

4.7  Transfer of risks

From the moment of the auction, the goods are placed under the full responsibility of the Acquirer : the blow of the hammer transfers ownership of the goods and risks to the Acquirer.

The Purchaser will not be able to hold Rossini responsible in the event of loss of damage, or theft of the lot after the auction.

 

4.8  V.A.T

All lots will be sold under the margin system. Any VAT invoiced will be reimbursed to Purchasers not resident in the European Union provided that they submit a written request to the accounting department within 3 months of the sale, and on presentation of copy 3 of the customs export document (DAU) on which SAS Rossini must appear as the consignor and the Purchaser as the consignee.

Export must take place within the legal deadlines.

 

4.9  Right of pre-emption

The State may exercise a right of pre-emption on the goods offered for sale at any public sale of works of art, by declaration of the Minister in charge of culture as soon as the adjudication of the object put up for sale has been pronounced. The French State has fifteen days from the date of the public sale to confirm the exercise of its right of pre-emption. In the event of confirmation, the State subrogates to the Purchaser.


5. Miscellaneous

 5.1  Anti-money laundering

As a sales intermediary in the art trade, Rossini is subject to obligations to combat money laundering and the financing of terrorism pursuant to Article L-561-2 of the Monetary and Financial Code.

 

5.2  Intellectual Property

The reproduction rights of Rossini's catalogs are the exclusive property of Rossini. Any reproduction or use of the catalogs without the express prior authorization of Rossini is prohibited, under penalty of legal action.

 

5.3  Applicable law and jurisdiction

These terms and conditions are subject to French law.

Any dispute relating to their existence, validitý, enforceabilitý and performance will be subject to the exclusive jurisdiction of the courts of Paris (France), unless mandatory provisions to the contrary.
